1שלא לבנות עיר הנדחת - שלא לבנות עיר הנדחת לעולם, ועל זה נאמר (דברים יג יז) והיתה תל עולם לא תבנה עוד.
To not rebuild an enticed city: To not ever rebuild an enticed city. And about this is it stated (Deuteronomy 13:17), “and it shall be an everlasting mound; you shall not build it again.”
2שרש המצוה כענין מה שכתבתי לעיל בסדר זה בשריפת עיר הנדחת (מצוה תסד).
The root of this commandment is like the matter that I wrote about in this Order about the burning of an enticed city (Sefer HaChinukh 464).
3מדיני המצוה. מה שאמרו זכרונם לברכה (סנהדרין קיא, ב) בפרוש לא תבנה, שאין בונין אותה לעשותה מדינה, דהינו בתים כמו שהיתה, אבל מתר לעשותה גנות ופרדסים. ויתר פרטיה, מבארים בפרק עשירי מסנהדרין. ואסור זה נוהג בזכרים ונקבות בזמן שדין עיר הנדחת נוהג, והוא בזמן שישראל על אדמתן וסנהדרין יושבין במקומן, כמו שכתבתי למעלה (מצוה תסד).
From the laws of the commandment — that which they, may their memory be blessed, said (Sanhedrin 111b) about the understanding of “you shall not build,” that we do not build it to make it a city, meaning houses like it was, but it is permitted to make it into gardens and orchards; and the rest of its details — are elucidated in the tenth chapter of Sanhedrin. And this prohibition is practiced by males and females at the time that the law of an enticed city is practiced — and that is at the time that Israel is on their Land and the Sanhedrin is sitting in its place, as I have written above (Sefer HaChinukh 464).
