1מצות שביתה ממלאכה ביום שמיני של סכות - לשבת ממלאכה שאינה צרך אכל נפש ביום השמיני של חג הסכות, שנאמר (ויקרא כג לו) ביום השמיני מקרא קדש יהיה לכם, והוא יום שנים ועשרים בתשרי.
The commandment of resting from work on the eighth day of Sukkot: To rest from any work which is not for the needs of food for the soul on the eighth day of the holiday of Sukkot, as it is stated (Leviticus 23:36), “on the eighth day, a holy occasion” — and that is the twenty-second day in Tishrei.
2משרשי מצות שביתת הרגל, כתבנו למעלה (מצוה רצז) ועוד נכתב בענין בעזרת השם, באסור מלאכה שביום זה בסדר זה (מצוה שכג), ושם נבאר שיום טוב זה, הוא יום טוב בפני עצמו.
I have written above (Sefer HaChinukh 297) about the roots of the commandment of rest on the festival. And we will write more about the matter with God’s help in the prohibition of work on this day in this Order (Sefer HaChinukh 323). And there we will elucidate that this holiday is a holiday on its own.
3ונוהגת בכל מקום ובכל זמן בזכרים ונקבות. ואף על פי ששביתת הרגל ממצות שהזמן גרמא הוא, אף על פי כן מכיון שבעשית המלאכה יש בה גם כן אסור לאו, הנשים חיבות בה, מן הכלל שבידינו (קידושין לה א) איש או אשה כי יעשו מכל חטאת האדם (במדבר ה ו) השוה הכתוב אשה לאיש לכל ענשים שבתורה. והעובר על זה ועשה מלאכה ביום זה בטל עשה, מלבד שעבר על לאו, כמו שנכתב בסדר זה בעזרת השם
And [it] is practiced in every place and at all times by males and females. And even though rest on the festival is from the positive commandments determined by time — since there is also the prohibition of a negative commandment in the doing of work, women are liable for it from the principle that is in our hands (Kiddushin 35a): “‘A man or a woman, if they do from any of the sins of a person’ (Numbers 5:6) — the verse equated a man and a woman for all of the punishments in the Torah.” And one who transgresses it and did work on this day has violated a positive commandment, besides that he violated a negative commandment, as we shall write in this Order (Sefer HaChinukh 323) with God’s help.
